Uniform Biological Material Transfer Agreement (Ubmta) Master Agreement

Addgene is a non-profit plasmid deposit that allows an easy distribution of plasmids to the scientific community. A Master Deposit Agreement from the universities of Basel, Bern and Zurich with addgene simplifies the process for researchers. The distribution of plasmids by additives is usually carried out under an UBMTA, unless no additional restrictions apply to the use of the specific plasmid. A master`s contract from the universities of Basel, Bern and Zurich with Addgene ensures a simple and fast process when ordering equipment. 10. COMMERCIAL PURPOSES: The sale, rental, license or other transfer of equipment or MODIFICATIONS to a for-profit organization. COMMERCIAL PURPOSES also includes the use of materials or modifications by an organization, including RECIPIENT, to conduct order searches, to study mixed libraries, to manufacture or manufacture products for general sale or for research activities leading to a sale, lease, license or transfer of materials, or modifications to a for-profit organization. However, scientific research with industrial support is not considered to be the use of equipment or MODIFICATIONS for COMMERCIAL PURPOSES as such, unless one of the above conditions of this definition is met. By executing an implementation letter in the attached form mentioning the materials to be transmitted, this organization undertakes to be bound by the terms and conditions of the “UBMTA”, which was published in the Federal Register on March 8, 1995. Often, the person who provides the material has exaggerated ideas about the possession of the research results obtained with the material. Sometimes even publication is prohibited.

Be very careful, especially for materials that have been obtained under an MTA by a company, so as not to let an agreement block your subsequent searches. Always insist on an MTA if you want to control the distribution of your hardware to third parties and/or the commercial application of the material you provide. The transfer of equipment to a company is generally governed by a commercial licensing agreement and not by an MTA. MATERIAL: original material, descendants and derivatives unchanged. The material must not contain: a) modifications or b) other substances produced by the recipient through the use of the material, which are not unchanged modifications, offspring or derivatives. On March 8, 1995, the National Institutes of Health (NIH) released the final version of the Uniform Biological Material Transfer Agreement UBMTA for the transfer of materials between non-profit organizations and a letter of execution for the transfer of biological material. The University of Chicago is one of the institutions signed by UBMTA. Unitectra either creates an MTA for you or reviews a contract that must be signed by the recipient of the material.
